SCHENECTADY — A man who was accused of raping a woman in Vale Cemetery was sentenced Friday to 10 years in state prison.

David Jones Jr., 59, said nothing at his sentencing in Schenectady County Court, something the prosecutor said helped show his lack of remorse.

“He never made a statement of admission, other than to plead guilty,” Assistant District Attorney Jessica Lorusso said. “He took it all the way through to trial and he put the victim through the horror of testifying.”

Jones pleaded guilty in April to one count of first-degree attempted rape, a felony. The plea came as his trial neared its conclusion, and after he rejected several plea offers.

Jones admitted he attempted to rape the woman in August. He was arrested shortly after the incident.

The woman told police she had been walking in Vale late in the afternoon when a man on a bicycle approached, dragged her into the woods and raped her over a four-hour period. Neighbors heard her cries for help and alerted authorities.

Investigators later found Jones walking down the street, minus his shoes and wearing only thermal pants. Police said they found sneakers, a pair of pants and a wallet containing Jones‘ identification at the scene, a patch of bushes near Maple Avenue.

Jones has a lengthy criminal record, including a prior history of sex offenses in both New York and New Jersey, Lorusso said.

The plea came after much of the testimony, including that of the victim, had already been entered. The last witness was someone who would testify to a past sex crime by Jones.

The victim’s testimony had been in doubt up until the trial, something that factored into a plea offer to Jones of 21⁄2 years.

Prosecutors feared they wouldn’t find the victim, until investigators located her in Florida. That led to an offer of 4 years, which Jones also rejected.

The victim was not at Friday’s sentencing, declining to make an impact statement.

Jones was represented at trial by attorney James Davis, who could not be reached for comment Friday.
