SCHENECTADY — The woman who transported cocaine and heroin for a local drug ring and whose initial attempt at a plea deal was rejected by a judge has now agreed to an acceptable deal.

Misty Gallo, 23, of Huron Court, agreed this morning to plead guilty to one felony count of second-degree criminal possession of a controlled substance in exchange for receiving a five-year prison term when she is sentenced in August.

Gallo had agreed earlier this month to plead guilty in exchange for a four-year sentence, but Schenectady County Court Judge Karen Drago said she would not sign off on any deal that did not include a sentence of at least 5-1/2 years in prison. Drago also objected to the fact that that proposed deal had been reported by The Daily Gazette before she had a chance to consider it.

In court this morning, Gallo's attorney, Stephen Rockmacher, said his client had taken responsibility for her role in the drug ring. Gallo said she suffered with bipolar disorder and was addicted to cocaine.

Gallo was among 24 accused of taking part in the drug operation, which authorities said had designs on controlling the region's drug market. The operation was allegedly headed by Oscar Mora and Kerry Kirkem, both of whom have already taken plea deals. Also indicted was Lisa Kaczmarek, wife of former Schenectady police chief Greg Kaczmarek.

Gallo admitted to being a drug mule for the operation, transporting cocaine and heroin from Long Island to Schenectady. On one such trip, investigators used a ruse to take the shipment in order to monitor the organization's reaction. Gallo's frantic calls to Kirkem after discovering the drugs were gone were documented on state wiretaps.
