Standing your ground, or not, in N.Y.

It’s probably not going anywhere, but yes, there is a “stand your ground” bill pending in the state Legislature — or pending in the state Senate, I should say, since it has no sponsor in the Assembly. It’s the brainchild of Sen. George Maziarz, Republican of Niagara County, who introduced it last year, well before “stand your ground” became a national issue with the infamous shooting in Florida of an unarmed teenager by a neighborhood-watch ...

The bill needs to be fine tuned and then passed and signed into law. A law like this will be good. Calling 911 and having to wait for God knows how long for the police to get to you just may be too late. You would be better off calling for medical help or a undertaker. Self protection is a basic right and it is about time criminals understand it.

wmarinic- good for you!!! we as a country need legislation like this. Everyone has a right to defend themselves I believe it is our constitutional right.
NYS tell us to run, are you kidding me!!!!. Did the Schenectady Police officers run from the situation at The Gazette building......NO!!!! Then why should we? These officers were trained in volatile situations like these. They did the right thing!!! What lawmaker or lobbyist would want someone to run, I don't quite understand.

To run or to defend yourself should be a personal choice. It should not be dictated by legislation. One who stands his ground against a criminal should not be prosecuted as a criminal. NYS coddles and protects criminals. That is why we have so many of them.

Stand your ground should apply to pedestrians and bicyclists too, who are threatened everyday by multi-ton missiles aimed their way everyday, often at speeds in excess of the speed limit. Most jump out of the way, those who don't are often dead or hospitalized.

Yes, bring it on! The handgun may make Erie Boulevard safer and cheaper than McCarthy's plan to procrastinate until he gets his multi-million dollar plan to redecorate, er I mean redevelop Erie Blvd.

Carl and other simple minded fools would like to think that a bill like this would have people start killing for any reason possible, this would never happen. Looks at the stats in states with these laws.

Those who are against these laws are saying "we don't want self defense to occur"

I don't think this law is even necessary and is a non-issue. If you actually read the contents of NYS Penal Code Article 35.15 & 35.20, you can defend yourself against imminent use of deadly physical force, you are under no obligation to retreat if you are in your dwelling (actual home or temporary dwelling), and you have an obligation to retreat elsewhere only if you can do so with complete personal safety of yourself or others. So if you can't safely retreat, and are about to be imminently injured\killed, it appears you already have a justification for using deadly physical force and standing your ground like this bill intends to provide if made law.

Bi, thats true but as it stands you will end up in court trying to prove you did not have the opportunity to safely escape and you will be doing this while facing murder charges all while a prosecutor uses everything he has against you. This will ruin your life. Go to a job interview and tell them you were arrested and charged with murder but were found not guilty....Spend a week in jail away from your family only to be bailed out and face a lengthy media covered trial.

The DA's and courts need a stronger message forcing them to respect victims so people do not have to face prison after they faced death at the hands of a criminal. If they don't want this stuff to happen start handling the problem, THE CRIMINALS

I am proof positive that stand your ground works. Had NM not had it in 1985 I would be either dead or possibly in prison.

If you use deadly force against someone, you're going to end up in court and the police station for a long time answering questions, and have your whole life history examined by the media, so your life will be turned upside-down regardless if this bill becomes law or not. Even if you are found justified in your defense by a court, lawyers (aka: sharks) for the other party will probably bring a wrongful death suit, or some other legal action, just to try and get money out of it and make your life hell too with legal fees.

Actually Laura I don't sell cars. I don't hate Obama because he is a black elitist constitutional scholar (laugh track). As the remarks that Obama made to the supreme court about their role in deciding Obamacare shows that he is about as far as you can get from a constitutional scholar. He is great at circumventing the constitution but that hardly makes him a scholar. And with my many years on this earth and seeing the truth (as I was for years a huge liberal) I don't suffer fools lightly. Am I here to make friends? No, I'm here to state the obvious and obviously you and I differ in our opinions. I applaud you that you are helping our children as that has also been something that I believe in and have supported in numerous ways in the last 20 years. When I respond to you Laura it is mostly in fun because even though I don't agree with most of what you say I have no ill will toward you. If you truly knew me then I'm sure your opinion would change but hey thats life. Peace.
