Convicted animal neglector accused of having more animals

— A woman convicted of not providing enough food and water to horses at her farm is now accused of violating her probation by again housing horses there.

One of the conditions of probation for Ann Arnold, 59, of 131 Wilton Road, was that she not own farm animals for the duration of her probation, but authorities said 17 horses were brought to Arnold's farm Monday. The animals had been kept at a property she and her brother own in Washington County, which is out of Saratoga County authorities' jurisdiction, said county District Attorney James A. Murphy III.

Arnold wasn't banned from having horses at the Washington County address, but was prohibited from having them in Greenfield.

She also failed to complete a court-mandated mental health evaluation and keep up to date on restitution payments, also conditions of her probation, Murphy said.

Greenfield Town Justice Michael P. Ginley could sentence Arnold to up to a year in jail for violating her probation on the misdemeanor charges. She is scheduled to appear in court Tuesday to be arraigned on the alleged violations.

Earlier this year, Arnold was convicted of 19 counts of failure to provide proper food, water and sustenance to horses on her property and one count of second-degree criminal nuisance. She was sentenced in July to three years of probation and a $500 fine.

Arnold this week allegedly tried to circumvent the ban on having horses by transferring the deed to the property to her brother, Murphy said. But Ginley's order still stands because it's tied to the property itself, not Arnold's ownership, he said.

"Despite her efforts, we maintain that the judge's decision actually anticipated this potential."

Neighbors called state police when the horses arrived Monday, Murphy said.
