Wilton man gets 1-3 years for attempted burglary

— A 37-year-old Wilton man was sentenced to one to three years in state prison Monday after pleading guilty to attempted burglary in connection with an incident last May that spanned three counties.

Nicholas P. Beer of Vincek Lane allegedly stole a box truck May 11 from a Wilton business and forced his girlfriend and two sons into it. They eventually ended up in Schoharie County, where he was charged with kidnapping.

He also climbed onto the roof of Excelsior Auto Parts in Saratoga Springs and stole wiring and copper tubing from that business, police said.

His girlfriend would not get into the stolen truck at first but he threatened her with a loaded .22-caliber rifle, police said. He told his two sons, 13 and 9, that he was moving them to a new home. Beer drove the truck to Otsego County and then to Schoharie County. State police apprehended Beer at a Mini Market in Richmondville. His girlfriend and sons were found in the truck, unharmed.

Saratoga County Judge Jerry J. Scarano sentenced Beer to one to three years in state prison and ordered restitution of $682 on the attempted burglary charge in Saratoga County, to which he pleaded guilty in September.

Saratoga County District Attorney James A. Murphy III said Monday that other charges, including kidnapping, are still pending against Beer in Schoharie County.

In other County Court cases Monday:

-- Joseph Guyett, 27, (also known as Joseph R. Guyette Jr.) of Avenue C in Mechanicville pleaded guilty to promoting a sexual performance by a child and possessing a sexual performance by a child stemming from his arrest in April of 2011 in the town of Malta. He will be sentenced in March.

-- Keith W. Adams, 34, of Front Street in Waterford pleaded guilty to third-degree rape stemming from his arrest Oct. 23 in Waterford. He will be sentenced in April.

-- Gavin Peck, 19, of Randolph pleaded guilty to second-degree committing a criminal sexual act, stemming from his arrest April 23 in Mechanicville. He will be sentenced in March.

-- Crystal A. Benway, 22, of Cortland Street in Glens Falls pleaded guilty to attempted sale of a controlled substance stemming from her arrest Sept. 5 in the town of Moreau. She will be sentenced in March.

-- Justin Ure, 31, of Malta Avenue in Ballston Spa pleaded guilty to driving while intoxicated stemming from his arrest Jan. 13 in Ballston Spa. He will be sentenced in March.

-- Kelly Peceu, 37, of Lamplighter Acres in Moreau pleaded guilty to third-degree grand larceny stemming from her arrest June 18 in the town of Moreau. She will be sentenced in March.

-- Dana M. Hughes, 20, of Van Buren Street in South Glens Falls pleaded guilty to fourth-degree grand larceny stemming from her arrest Nov. 23 in Moreau. She will be sentenced in March.
