The man who held police at bay for nearly 11 hours after climbing a tree along Interstate 890 this week has been charged with resisting arrest, authorities said.

Scott Modest, 29, of Duane Avenue, is expected to be arraigned on the misdemeanor charge Friday morning in City Court.

Modest is accused of staying up the tree near mile marker 7 until finally being pulled out by rescuers early Wednesday.

He is accused in court papers of attempting to prevent his arrest on an outstanding bench warrant by “running up a large tree” and refusing to come down, according to papers filed in court.

The incident shut down one lane of the highway for the duration.
