A state appeals court has overturned the conviction of an Albany man accused of killing a police informant because prospective jurors at his trial were given the wrong oath.

Michael Hoffler was found guilty of first-degree murder in 2007 for his role in the shooting death of drug informant Michael Drabik. Authorities say the 2003 murder was planned and carried out by a group of drug dealers led by Hoffler.

He was sentenced to life in prison without parole.

The state Appellate Division overturned the conviction today because the Rensselaer County Commissioner of Jurors made a mistake administering the oath to jurors.

District Attorney Richard McNally says his office will take the case to the Court of Appeals.
