The 15-year old accused with the fatal shooting of 10-year old Kathina Thomas was indicted today by an Albany County grand jury on several charges, including murder.
Jermayne Timmons of 131 Clinton Ave. was charged with two counts of second-degree murder, as well as single counts of manslaughter and criminal possession of a weapon. If convicted of the murder charges, he faces a sentence of at least 7 1/2 years to life in prison.
Police say Timmons fired a .45 caliber handgun May 29 and the bullet killed Thomas as she played in front of her home on First Street. In a statement to police, Timmons said he used a community gun that was hidden under a shed at the Ida Yarborough Apartments for anyone in the neighborhood to use.
Timmons is being held without bail at the Albany County Juvenile Detention Facility.
