The Mohonasen teacher who was arrested last year and charged with having drugs in his car has resigned his position.
Kristofer P. Rose, 33, submitted his resignation last month effective June 30, according to Mohonasen Central School District spokeswoman Adrienne Leon.
School officials had still been seeking to terminate Rose. A hearing at the state Education Department was scheduled for late June but Rose resigned, so it was canceled. Rose was out on paid suspension for the entire 2010-11 school year, earning $68,802.
Rose had been out of the classroom since his arrest May 23, 2010, when police said he was acting suspiciously in his car, which was parked at the intersection of Broadway and North Ferry Street in Albany. He allegedly had one piece of crack cocaine in the car and a piece of paper with powdered cocaine in his pocket. He was charged with seventh-degree criminal possession of a controlled substance, a misdemeanor.
His attorney, Dennis Schlenker, argued the search was illegal because Officer Bret Phillips did not have cause to detain Rose after he answered his questions about why he was in the area.
Albany City Court Judge Rachel Kretser granted the motion and threw out all the evidence collected from the car and the incriminating statements Rose made later at the police station. Prosecutors have not dropped the charges and are appealing the decision to suppress the evidence. Another hearing is scheduled for Thursday in Albany City Criminal Court.
Neither prosecutors nor Schlenker could be reached for comment Friday.
