A man who admitted to stabbing a woman to death on Clinton Street in January has asked a judge to allow him to take his guilty plea back.

Perry L. Miller, 33, formerly of State Street, pleaded guilty in May to one count of fi rst-degree manslaughter in the killing of 43-year-old Tammie Washington on Clinton Street after a heated argument.

Miller appeared in Schenectady County Court Wednesday with attorneys Kent Gebert and Steve Kouray. In his motion, Kouray argued Miller didn’t knowingly and voluntarily make his plea. He argued that Miller didn’t know everything involved in a claim of self-defense, including what prosecutors had to prove.

Drago could rule on the motion next month.

Miller had initially been charged with second-degree murder, which carries a maximum sentence of 25 years to life in prison.

Prosecutors offered the plea deal believing a jury could have concluded Miller intended to seriously injure, not kill. Miller remains in custody.
