Police allege an Amsterdam man struck his girlfriend’s son with a baseball bat before the son smashed a fish tank and damaged a door.
Harry L. Ballard, 48, and Brad E. Miller, 25, both of 1 McClellan Ave., are facing felony charges following the incident early Monday morning, according to a release from the Amsterdam Police Department.
Police in the release said officers responding to a 12:30 a.m. disturbance call at the McClellan Ave. home were led downstairs by a female resident and found the fish tank smashed and a kitchen door broken.
Police interviewed Ballard and Miller and allege Miller threw a mason jar at Ballard before Ballard picked up a baseball bat and hit Miller in the neck.
Miller allegedly became angry, police allege, then overturned the fish tank before breaking the door.
Miller was taken to St. Mary’s Hospital, treated and released.
Ballard was charged with second-degree assault and Miller was charged with third-degree criminal mischief. Both were awaiting arraignment Tuesday morning.
