State police have charged a 26-year-old upstate man with trying to kill a turkey buzzard, which is a protected species in New York.

Troopers say they received a call on Sunday from a man who reported gunfire near his home in the rural Rensselaer County town of Pittstown, 15 miles northeast of Albany.

Police say when the man approached two men, one of them fired a rifle over his head at a flying turkey buzzard.

A trooper and a state environmental conservation officer arrived on the scene and eventually found the two men. The one who shot the rifle over the homeowner’s head was charged with shooting within 500 feet of a dwelling, taking small game out of season, shooting over a public highway and attempting to take a protected species.
