A city resident has been charged with murder in the May 6 home invasion killing of a Brooklyn man.

Arsheen J. Montgomery, 23, of Delamont Avenue, faces one count of second-degree murder.

He is accused of killing 29-year-old Taquan Foreman inside 410 Paige Street, Apt. 1, just after 10:30 p.m., records show.

Montgomery was previously charged with hindering prosecution in the case. Also charged is 19-year-old Albany Street resident Jahsiah Tucker. Tucker faces one count each of first-degree burglary and first-degree attempted robbery.

Tucker is accused of illegally entering the apartment, intending to rob someone, according to papers filed in his case.

Court paperwork says Tucker committed the burglary “while one of the subjects was armed with a handgun and caused the death of a victim.”

Court filings allege that Montgomery shot the victim in the torso with a handgun, causing his death.

Foreman died at Ellis Hospital that night after being brought there by a private vehicle.

Police did not comment on Montgomery’s arrest Wednesday. He appeared in City Court earlier this week with attorney Mark Juda. Juda could not be reached for comment.

Prosecutor Peter Willis of the Schenectady County District Attorney’s Office called the incident a home invasion.

Authorities believe Montgomery, Tucker and a third person went intending to rob the residents. A struggle involving Foreman took place and Foreman was shot and killed, Willis said.

Willis described Foreman as a friend of one of the residents of the apartment. He also said that authorities believe that Foreman and the others inside the apartment were unarmed.

Willis did not identify what the invaders sought, but he did say that a search of the residence uncovered some drugs.

Foreman’s mother, Charlotte Foreman, last week recalled her son as a loving and humorous person. He loved basketball, boxing and music. She said he worked in construction and other jobs.

Told of Montgomery’s arrest Wednesday, she called it a relief. She also said she wants to know exactly how and why her son died.

Montgomery remained held Wednesday without bail at the Schenectady County Jail. Tucker continued to be held on $60,000 bail.
