12 years for Mont Pleasant shooting

SCHENECTADY — A man who shot another man after a confrontation at the troubled Chubby’s pizza received 12 years in state prison this week, prosecutors said.

Karim Smith, 33, of Van Vranken Avenue, shot the man Aug. 14, 2016, with an illegally possessed gun, a jury found in June.

The victim has some lingering effects, but has largely recovered, prosecutors said.

Street cameras captured Smith pulling up in front of the market, stashing the gun in his waist band and entering the store. Once inside, he started a confrontation with others there.

He and two men then left the store and one of the men thew a punch at Smith, prosecutors said. Smith responded by pulling out his .45-caliber handgun and shooting one of the men in the busy area as he ran away, prosecutors said.

Prosecutor Amy Burock asked for 22 years in prison, the maximum. Defense attorney Michael Horan asked for less.
