
BALLSTON SPA — A Saratoga Springs man accused of entering an apartment and inappropriately touching an 8-year-old girl while she slept last December was indicted on four felony charges Wednesday by a Saratoga County grand jury.
Michael A. Capone, 62, of Lincoln Avenue, was indicted on two counts of predatory sexual assault against a child, and one count each of first-degree sexual abuse and fourth-degree grand larceny, as well as endangering the welfare of a child.
Capone was arrested by city police in January in connection with the alleged incident, which police said occurred Dec. 30.
The man was known to the victim and was a regular visitor to the apartment, police said at the time.
Officers were called to the apartment after the girl reported the incident to her mother, who was in another room. Police said the girl was asleep on a couch when Capone entered the apartment and subjected her to inappropriate contact.
Capone will now appear in Saratoga County Court to respond to the indictment.
