NISKAYUNA — The controversy over a Town Court employee entrance that was disabled has been resolved, town officials say.
The town supervisor’s action to disable the entrance had led to a complaint filed with the state Labor Department that alleged retaliation.
Town Board member and Deputy Supervisor Denise Murphy McGraw on Thursday issued statement that read:
“Niskayuna Town Supervisor Joe Landry and Town Justice Stephen Swinton have resolved the issue related to an entrance at Town Hall. The door is (in) operation for Town Court employees. Furthermore, the complaint is being withdrawn from Department of Labor.”
Calls to Landry, Barbara Pidgeon, who is the court clerk and person who filed the complaint, and the Department of Labor were not immediately returned.
Murphy McGraw said in a separate email:
“While we may have differing opinions about how to achieve the goal, the safety and security of our employees is paramount. Supervisor Landry felt he offered a safer alternative, however Judge Swinton and his staff feel more comfortable using the side door. Now that the board has made their views known, we were able to come to a resolution. I’m just sorry this was not raised in February, 2016 during the Judge Swinton’s State of the Court report to the board or at any of the monthly meetings of the Public Safety Committee.”
Swinton said he did not speak with the supervisor, but was told the door’s lock was being repaired and the door could be used by court employees. A court employee also informed Swinton that she saw workers restoring the locks.
Swinton said he spoke with Pidgeon and since the matter came to a favorable conclusion, Pidgeon’s complaint will be withdrawn.
“I appreciate Denise [Murphy McGraw] getting involved,” Swinton said. “And I’m glad it’s resolved.”
