13 arrested in Montgomery County-based underage rape sting

TOWN OF FLORIDA – Thirteen people have been arrested in an underage rape sting, accused of trying to rape a child under the age of 15, state police said Monday.

Most of the men are from the Capital Region, state police said, with addresses from Fulton County to Albany County.

The arrests came as a result of an investigation by the state police in Fonda, with the Montgomery County Sheriff’s Office, state police Troop G Computer Crime Unit, the FBI, and the FBI Task Force.

Each of the 13 is accused of acting independently and each sought out the person they believed to have been a child, Montgomery County Sheriff Jeff Smith said Monday. The operation took place from May 9 to May 11.

Each of the 13, however, were actually communicating with a law enforcement individual, Smith said. They drove to a specific location in the Town of Florida, where state police or sheriff’s investigators were waiting for them. He declined to detail the operation further.

Smith said the joint operation took advantage of the great working relationship his department has with the state police and sends the message that they are going after people who try to commit these acts and that it won’t be tolerated. 

“Unfortunately, there was no shortage of people to arrest and that’s disheartening,” Smith said.

Those arrested and their charges, according to the state police:

  • Tyler D. Phillips, 24, of Fonda,, second-degree attempted criminal sexual act, second-degree attempted rape
  • Daurell J. McNeil, 32, of Highland, Ulster County, second-degree attempted criminal sexual act, second-degree attempted rape, seventh-degree criminal possession of a controlled substance, unlawful possession of marijuana
  • Osborne M. Campbell, 38, of Delanson, second-degree attempted criminal sexual act, second-degree attempted rape
  • Samuel S. Ambrosio-Vicente, 27, of Albany, second-degree attempted rape, second-degree patronizing a prostitute, second-degree criminal possession of a forged instrument
  • Vincent M. Tebano, 60, of Schenectady, second-degree attempted criminal sexual act, second-degree attempted rape
  • Mikhail Donovan, 27, of Melrose, second-degree attempted rape 
  • Vejay Etwardo, 29, of Schenectady, second-degree attempted rape
  • Jason D. Shattuck, 29, of Gloversville, second-degree attempted criminal sexual act, second-degree attempted rape, resisting arrest
  • Gregg Townsend, 26, of Queensbury, second-degree attempted criminal sexual act, second-degree attempted rape
  • John J. Hoag, 41, of Gloversville, second-degree attempted criminal sexual act, second-degree attempted rape, unlawful possession of marijuana
  • Robert K. DiGregorio, 48, of Gloversville, second-degree attempted criminal sexual act, second-degree attempted rape
  • David J. Kondrat, 57, of Middle Grove, second-degree attempted rape, second-degree patronizing a prostitute, resisting arrest
  • Stephen C. Pastorek, 50, of Albany, second-degree attempted criminal sexual act, second-degree attempted rape, fifth-degree criminal possession of a controlled substance, seventh-degree criminal possession of a controlled substance.

Each of the defendants was arraigned in Town of Florida Court and ordered held on $10,000 bail, state police said.
