Police: Abducted Clifton Park boy found safe in Albany, father arrested; Community tips credited

CLIFTON PARK – The Clifton Park boy police say was abducted from his home early Friday by his father has been found safe and the father arrested, Albany Police tweeted late Friday.

Police there took suspect Nivaldo Oliveira into custody Friday evening near Ontario Street and Livingston Avenue and also located the child, 9-year-old Gustavo Oliveira, found safe, police said.

“Shortly after 9pm, members of the Albany community notified the police after observing Oliveira walking with the child on Ontario Street. He was taken into custody shortly after by officers nearby,” Albany Police Spokesman Steve Smith announced on Twitter shortly before 10 p.m.

The state police had issued an Amber Alert early Friday after they said Oliveira took the boy from his home. Police believed the child was in danger of serious harm or death.

The abduction came three months after Nivaldo Oliveira was accused of breaking into his estranged wife’s apartment while she and a child hid in an upstairs bathroom and called police, records show.

Oliveira was charged with felony burglary in the earlier case, arraigned and released on his own recognizance, court officials said Friday. He failed to show up for court two weeks later and a warrant has been out for him since, court officials said.

The child was identified as Gustavo Oliveira, 9, and he was taken at about 1 a.m. Friday from Tallow Wood Drive, state police said.

The suspect was identified as Nivaldo P. Oliveira, 41. He was last seen traveling on Tallow Wood Drive, state police said.

“The child was taken under circumstances that lead police to believe that they are in imminent danger of serious bodily harm and/or death,” the state police Facebook posting reads.

A state police spokeswoman later Friday morning called the investigation “very active” and asked that people look at the photos and contact police if they have any information on their whereabouts, which Albany Police indicated the public did.

The early Friday abduction comes about three months after Nivaldo Oliveira was accused of breaking into his estranged wife’s Halfmoon apartment and disconnecting a surveillance camera while she hid in an upstairs bathroom with a child, state police said at the time.

Nivaldo P. Oliveira, was arrested then on charges of second-degree burglary, a felony, along with fourth-degree stalking, a misdemeanor.

Oliveira was accused of illegally entering the woman’s residence on Feb. 9 at about 10:30 p.m. He then remained inside and concealed himself under the couch for a period of time while the woman, as well as a child, hid in the upstairs bathroom and the woman called 911, according to allegations filed in court then. He also disconnected a camera there, state police said.

According to the allegations, he fled then without interacting with the woman or child and before authorities arrived.

State police then caught up with Oliveira on Feb. 12 when he returned to the victim’s home and arrested him.

He was then arraigned in Halfmoon Town Court and released, a court official said Friday. He was due back in court Feb. 26, but never showed, the official said.

Just eight days before the Feb. 9 incident, Oliveira was charged with misdemeanor trespass and child endangerment on similar accusations, according to allegations filed in court for that case.

In the Feb. 1 incident, Oliveira was accused of entering the residence without permission and remaining there after being told several times to leave. He was also accused of closing a child’s arm in a door while trying to stop the woman from leaving, according to the allegations.
