ALBANY – An Albany man took a topless photo of a 16-year-old and then posted it to social media earlier this year, police said Monday.
Timothy Burnham, 48, was arrested Monday morning and charged with two counts of possessing an obscene sexual performance by a child, felonies, and one count of endangering the welfare of a child, a misdemeanor.
Burnham is accused of taking the photo earlier this year at Washington Park and then posting it to his Instagram account in May, police said. He knew the victim and had been allowing her to stay at his residence at the time of the incident, police said.
He was to be arraigned Monday afternoon.
