Troopers: Johnstown man drove drunk with three children in car

EPHRATAH – A Johnstown man drove drunk Sunday with three children in his car, state police said Tuesday.

Erik W. Frascatore, 29, of Johnstown, was arrested and charged with three counts of felony aggravated driving while intoxicated under Leandra’s Law.

Troopers stopped him just before 5 p.m. Sunday on Route 29 in Ephratah. Troopers responded there for a report of an erratic driver, state police said.

Troopers found the vehicle and observed the driver commit multiple infractions and stopped him. Speaking with the driver, Frascatore, the trooper could smell alcohol on his breath.

The trooper also spotted three children in the car.

Frascatore failed field sobriety tests and later provided a breath sample that came back with a blood alcohol content of 0.11 percent, above the limit of 0.08.

Frascatore was processed and released to appear in court later. Police turned over the children to a third party.
