Troopers: Driver drunk in Clifton Park traffic stop, had three kids under 16 in car

CLIFTON PARK – A Saturday traffic stop in Clifton Park led to a drunk driver driving with three children in his car, state police said.

Brian S. Brust, 40, of Wynantskill, was arrested and charged with one count of Leandra’s Law DWI, a felony, state police said.

Troopers stopped Brust just after 8 p.m. Saturday on Fire Road in Clifton Park for a traffic infraction, state police said.

When the trooper spoke to Brust, the trooper could smell alcohol coming from inside the car. The trooper also spotted three children under the age of 16 in the vehicle, state police said.

Brust was administered roadside sobriety tests, which he failed, and he was taken into custody, state police said.

Brust was taken back to the barracks and he provided a breath sample that came back at 0.09 percent blood alcohol content. The legal limit to drive is 0.08 percent.

Brust was processed and released to appear in court later. The children were released to the care of family.
