The father of a 15-month-old child who died from head injuries this week at Albany Medical Center Ho

The father of a 15-month-old child who died from head injuries this week at Albany Medical Center Hospital was indicted today on charges of second-degree murder and second-degree manslaughter.

Warren County District Attorney Kathleen "Kate" Hogan said a Warren County grand jury returned the two-count indictment against Gary Lee Waite, 28, of Orville Street, Glens Falls.

The child, Jesse Smith, was seriously injured Monday at the hands of his father, police said. The child died Wednesday evening at Albany Medical Center.

Glens Falls police originally charged Waite with second-degree assault, a class D felony.

Police responded Monday to 3 Orville Street, along with the Glens Falls Fire Department, on a medical emergency call. The toddler was transported to Glens Falls Hospital and airlifted to Albany Medical Center with serious head injuries.

Police said Waite told them he threw the boy onto a couch and the child bounced to the floor, injuring his head.
