A city man was charged Thursday with inappropriately touching a highly intoxicated woman and taking lewd photos of her.
City police said they received a medical assistance call about 3:15 p.m. Thursday for a highly intoxicated 26-year-old woman on Lincoln Avenue. The caller, Robert Gardner, 62, was at the scene when emergency responders arrived to find the woman not alert on the back porch of the home.
The woman was taken to Saratoga Hospital, while officers began a preliminary investigation. Police said Gardner’s initial account of what had happened did not seem to match up with observations and information collected by officers, and further investigation led to allegations that Gardner had sexual contact with the victim while she was unconscious and took several pictures with his cellphone before calling police.
Gardner was charged with felony counts of first-degree sexual abuse and second-degree unlawful surveillance. He was arraigned in City Court and released.
