Colonie police have arrested a 38-year-old Albany man in the attempted robbery of a McDonald’s restaurant Monday.

Jose Rivera Jr., of 256 Third St. Apt. 1, was an employee at the McDonald’s on Osborne Road at the time of the robbery, police said. A BB gun police say he used in the attempted robbery has been recovered.

The incident occurred at 5:14 a.m. Monday at 256 Osborne Road. Police say Rivera struck a female employee in the head. Another suspect who stayed by the door during the robbery has been identified and charges are pending, police said.

Rivera has been charged with three counts of second-degree attempted robbery, third-degree criminal possession of a weapon, and second-degree assault, all felonies.

He will be arraigned in Colonie Justice Court at 6 p.m. today.
