Two Ballston Spa High School students have been arrested on charges of distributing or possessing indecent material after one of them allegedly distributed nude photos of female students, the Saratoga County Sheriff’s Department said.
Elijah M. Drew, 16, and Nicholas M. Mayr, 16, both of Rock City Road, are the students facing charges, deputies said Tuesday. Drew is charged with disseminating indecent material to minors and Mayr is charged with possession of sexual performance by a child.
Deputies said the arrests came after the department received a complaint from Ballston Spa High School on Oct. 28.
Drew was accused of sending photos of nude females to other minors, meaning the recipients were less than 17 years old. The images were on a cellphone, deputies said.
Both Drew and Mayr were released to answer the charges at a later date. Drew will answer the charge in Milton Town Court and Mayr will answer the charge in Ballston Town Court. Further investigation was conducted after the initial arrests on Oct. 28, but no additional arrests are expected, deputies said Tuesday.
Ballston Spa school officials issued the following statement:
“High school administration was made aware of two 16-year-old students who had indecent material on their cellphones. It was investigated and called into the Saratoga County Sheriff’s Office for followup. “The school follows procedures and protocols as outlined in the Student Code of Conduct.”
