TOWN OF FLORIDA -  At least three of the 13 men arrested earlier this month in a state police-Montgomery County Sheriff underage rape sting offered cash to the children they intended to rape, according to state police and documents filed in court.

One man charged, Vincent M. Tebano, 60, of Rotterdam, offered $150 to "a person he believed to be less than fifteen years old" in exchange for raping the child, according to sheriff's allegations filed in court. Another charge filed against Tebano indicates he allegedly believed the person to have been 14.

Another man, David J. Kondrat, 57, of Middle Grove, offered $40 to a person he believed to be less than 15 years old in exchange for orally raping the child, according to state police allegations filed in his case.

Tebano and Kondrat were among 13 men charged in the sting earlier this month in Montgomery County. Each of the 13 faces an attempted rape charge. Most face other charges, as well.

Tebano, Kondrat and a third man, Samuel S. Ambrosio-Vicente, 27, of Albany, were each also charged with felony second-degree patronizing a prostitute in the sting, according to state police and court records. The charge is a felony due to the age they allegedly believed the person they were paying to be.

Tebano's patronizing a prostitute count was not included in a state police release last week, which listed his two other felonies, attempted rape and attempted criminal sexual act. Tebano was also listed as from Schenectady, though court filings indicate he is actually a Rotterdam resident.

The arrests came as a result of an investigation by the state police in Fonda, with the Montgomery County Sheriff's Office, state police Troop G Computer Crime Unit, the FBI, and the FBI Task Force.

Each of the 13 is accused of acting independently and each sought out the person they believed to have been a child, Montgomery County Sheriff Jeff Smith said last week. The operation took place from May 9 to May 11 and was announced May 20.

Each of the 13, however, were actually communicating with a law enforcement individual, Smith said then. The defendants drove to a specific location in the Town of Florida, where state police or sheriff's investigators were waiting for them. He declined to detail the operation further.

Court documents filed by law enforcement also give a glimpse of the reactions of two of the men, Kondrat and Jason Shattuck, 29, of Gloversville, when confronted individually by officers. Kondrat and Shattuck each were also charged with misdemeanor resisting arrest. 

Kondrat is accused of "pulling away from police officers and refusing to comply with oral instructions after being advised he was under arrest," the state police allegations read.

Shattuck, who was being arrested on second-degree attempted rape and attempted criminal sexual act counts, reacted to troopers identifying themselves and advising him that he was under arrest by "physically fleeing," the state police allegations read.

Those arrested and their charges, according to the state police and court documents:

  • Tyler D. Phillips, 24, of Fonda,, second-degree attempted criminal sexual act, second-degree attempted rape
  • Daurell J. McNeil, 32, of Highland, Ulster County, second-degree attempted criminal sexual act, second-degree attempted rape, seventh-degree criminal possession of a controlled substance, unlawful possession of marijuana
  • Osborne M. Campbell, 38, of Delanson, second-degree attempted criminal sexual act, second-degree attempted rape
  • Samuel S. Ambrosio-Vicente, 27, of Albany, second-degree attempted rape, second-degree patronizing a prostitute, second-degree criminal possession of a forged instrument
  • Vincent M. Tebano, 60, of Rotterdam, second-degree attempted criminal sexual act, second-degree attempted rape and second-degree patronizing a prostitute.
  • Mikhail Donovan, 27, of Melrose, second-degree attempted rape 
  • Vejay Etwardo, 29, of Schenectady, second-degree attempted rape
  • Jason D. Shattuck, 29, of Gloversville, second-degree attempted criminal sexual act, second-degree attempted rape, resisting arrest
  • Gregg Townsend, 26, of Queensbury, second-degree attempted criminal sexual act, second-degree attempted rape
  • John J. Hoag, 41, of Gloversville, second-degree attempted criminal sexual act, second-degree attempted rape, unlawful possession of marijuana
  • Robert K. DiGregorio, 48, of Gloversville, second-degree attempted criminal sexual act, second-degree attempted rape
  • David J. Kondrat, 57, of Middle Grove, second-degree attempted rape, second-degree patronizing a prostitute, resisting arrest
  • Stephen C. Pastorek, 50, of Albany, second-degree attempted criminal sexual act, second-degree attempted rape, fifth-degree criminal possession of a controlled substance, seventh-degree criminal possession of a controlled substance.

Each of the defendants was arraigned in Town of Florida Court after their arrests and ordered held on $10,000 bail, state police said.
