Feds: Johnstown man admits heroin and fentanyl charge

ALBANY — A Johnstown man admitted this week to possessing and intending to distribute more than 100 grams of heroin mixed with fentanyl, federal prosecutors said.

Victor M. Diaz, 29, appeared in federal court Tuesday and pleaded guilty to the count. He is to be sentenced in October.

Diaz was arrested March 7 during a raid on his home, officials said. Drug Enforcement Administration agents and other law enforcement officers found him home alone and sitting near a suitcase that contained 1,740 small glassine bags, prosecutors said.

The bags contained approximately 89 grams of heroin mixed with fentanyl. Officers also found a plastic container that contained an additional 53.5 grams of heroin mixed with fentanyl, prosecutors said.

Diaz faces at least five years and as much as 40 years in prison at his sentencing.
