COLONIE - A man who described himself as homeless broke into a coffee kiosk at Colonie Center on three separate occasions after hours, Colonie police said.

Peter M. Risto, 41, homeless, was arrested early Tuesday while in the act of burglarizing the High Voltage Coffee and Tea kiosk inside the mall, police said.

The kiosk owner reported it had been broken into on three prior occasions over recent nights. The owner also had surveillance images of the suspect, but couldn't immediately provide a copy to officers.

The suspect took $30 in food items Sunday and just over $21 in food items Monday. The suspect also did $200 in damage Sunday, police said.

The mall has an overnight security patrol, but they were unsuccessful in locating the suspect, police said.

Officers caught Risto after placing two officers inside the mall. Just after midnight, they spotted Risto entering the kiosk and arrested him, police said.

Risto has been sent to prison previously for burglary, records show. He was sentenced in 2009 to 2 to 6 years in connection with another Albany County burglary, state records show.

Risto faces one count of third-degree burglary, a felony, misdemeanor attempted petit larceny and violation trespass. Charges related to the previous break-ins are expected, police said.
