MALTA — An off-duty officer spotted a man slumped at the wheel early Monday, but the driver soon woke up and led responding deputies on a brief chase, Saratoga County Sheriff's officials said.

The case soon ended when the driver pulled into a driveway, officials said. No one was injured.

Arrested was Darin C. Dinallo, 43, of Brownell Road, Malta. He faces one count each of driving while intoxicated and first-degree aggravated unlicensed operation, felonies.

The felony DWI charge was lodged as Dinallo has three prior DWI cases in the past 10 years, officials said. He also remained on probation for prior DWIs and was found to have circumvented an ignition interlock device in driving Monday, officials said.

Monday's incident began at about 12:24 a.m. in the area of Malta Avenue and Old Post Road in Malta, officials said, when an off-duty officer spotted Dinallo slumped at the wheel.

Dinallo, however, soon woke up and drove off down Malta Avenue, officials said. Responding deputies spotted him at Van Aernem Road and attempted to stop him, but Dinallo failed to stop.

A pursuit then began and then ended when Dinallo pulled into a driveway on Brownell Road, officials said.

Dinallo refused a breath test and was arraigned and held, officials said.

Dinallo also faces misdemeanor counts of third-degree unlawful fleeing a police officer in a motor vehicle, circumventing an ignition interlock device, second-degree criminal contempt, reckless driving and second-degree aggravated unlicensed operation. He also faces multiple violations.
